This page describes how the website is managed in relation to the processing of personal data of users consulting it.

The disclosure also refers to the Recommendation no. 2/2001 that the European authorities for the protection of personal data, gathered in the Group established by art. 29 of the directive no. 95/46/EC, adopted on 17th May 2001 to identify certain minimum requirements for the collection of personal data online, and, in particular, the methods, timing and nature of the information that the data controllers must provide to the users when they connect to web pages, regardless of the purpose of the web connection.

LEGAL BASIS OF THE PROCESSING

The personal data indicated on this page are processed as necessary for the pursuit of the legitimate interest of the owner in guaranteeing the regular functioning of the web services offered, in obtaining anonymous statistical information on visits and on the use of the services themselves (Article 6, par. 1, letter f) of the Regulation), as necessary for the execution of a contract or pre-contractual measures (Article 6, paragraph 1, letter b) of the Regulation) in order to respond to requests sent to us and on the basis of the consent (Article 6, paragraph 1, letter a) of the Regulation) in order to send newsletters for promotional purposes.

TYPES OF DATA PROCESSED AND PURPOSE OF THE TREATMENT

Browsing data
The IT systems and software procedures responsible for the functioning of this website acquire, during their normal activity, some personal data for which the transmission is implicit in the use of Internet communication protocols.
This is information that is not collected to be associated with identified subjects, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified.
This category of data includes IP addresses or domain names of the computers used by the users who connect to the website, the addresses in URI (Uniform Resource Identifier) notation of the required resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the code number indicating the response status given by the server (successful outcome, error, etc.) and other parameters related to the operating system (fingerprint) and to the user's IT environment.
These data are used for the sole purpose of obtaining anonymous statistical information on the use of the website, to allow browsing the website and to check its correct functioning. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the website, and for the same reason kept by the ISP (Internet Service Provider, Internet connectivity provider) and by the web host.

Data communicated by the user
The optional, explicit and voluntary sending of e-mails to the addresses indicated on this website involves the subsequent acquisition of the sender's address, necessary in order to respond to requests, and of any other personal data contained in the message itself. The e-mail address thus acquired is not used for other purposes and the simple sending of an e-mail for contact purposes does not entail the registration to mailing lists with the purpose of sending advertising material. For the processing in question it is not necessary to acquire your prior consent as responding to the requests sent to us represents a legitimate interest of the Data controller.
The processing of the data requested is therefore optional but necessary for the purpose of formalising your request: if you refuse to provide such data Hotel Fontanelle will not be able to take your request into consideration.
Your data will be stored no later than the termination of the request.

Book
Through the Book section you can make your reservation by connecting to the appropriate platform managed by our supplier Blastness Srl, identified as the Data Processor. To make the reservation it will be necessary to enter some contact data, for the processing of which it will not be necessary to acquire prior consent, since the processing in question is necessary for the execution of a contract or pre-contractual measures at the request of the interested party. ; therefore the provision of data is to be considered necessary to make the reservation: failure to provide them would make it impossible to manage the online booking.
The insertion of data for the purpose of booking the stay does not involve automatic registration in a mailing list for promotional or commercial purposes.
The data collected in this way are kept for the time strictly necessary to register the reservation and manage the charges.

Newsletter
By subscribing to the newsletter, the e-mail address is acquired and registered within a mailing list of contacts to which messages with advertising and promotional content can be transmitted. To register, you must fill in the appropriate field by entering the e-mail address, which will be automatically acquired by the MailUp system, through which the consent will be stored and the newsletter managed.
This activity is possible only upon acquisition of the user's consent, which can be expressed through the appropriate check-box, consent to be considered free and freely revocable at any time, by clicking on the footer of our emails or by writing to info@hotelfontanelle.it 
The data are not subject to profiling or automated decision-making.

DATA RECIPIENTS

The browsing data and the cookies collected due to the connection to the web services are processed by the ISP (Internet Service Provider, internet connection provider) and by the web host (provider that materially hosts the web server inside their own machines), according to the fulfilment of contractual and legal obligations; moreover, even companies providing assistance and maintenance services for the corporate network may have to process browsing data.
The data collected through contact form or by the spontaneous sending of e-mails aimed at requesting information are processed by internal staff, specifically authorised, and are not communicated to others or even disclosed.

SUBJECTS' RIGHTS

In relation to the aforementioned processing and related data present in our archives, the rights as of Chapter III, arts. From 15 to 22 of the EU Regulation 2016/679 can be exercised, and more specifically:

  • Right of access (art.15);
  • Right of rectification (art.16);
  • Right of cancellation (so-called right to be forgotten, art. 17);
  • Right to limit the processing (art. 18);
  • Right to data portability (art. 20);
  • Right of opposition (art. 21).

RIGHT TO PROPOSE A CLAIM TO A CONTROL AUTHORITY

Pursuant to art. 13, paragraph 2, lett. d) You are informed of the right to propose a claim to the Authority for the Protection of Personal Data if you find a violation of your rights as subject or for matters concerning the processing of your personal data.
The requests relating to the aforementioned articles of the EU Regulation no. 679/2016, must be forwarded to the Data controller using the contacts indicated at the top of this statement.
