pursuant to art. 13 of the EU Regulation no. 679/2016


This page describes how the website is managed in relation to the processing of personal data of users consulting it.

This is a disclosure that is also provided pursuant to art. 13 of the EU Regulation no. 679/2016, Regulation on the protection of personal data to those who consult the web services of Hotel Fontanelle S.N.C. accessible electronically from the address:

The disclosure also refers to the Recommendation no. 2/2001 that the European authorities for the protection of personal data, gathered in the Group established by art. 29 of the directive no. 95/46/EC, adopted on 17th May 2001 to identify certain minimum requirements for the collection of personal data online, and, in particular, the methods, timing and nature of the information that the data controllers must provide to the users when they connect to web pages, regardless of the purpose of the web connection.

TYPES OF DATA PROCESSED

Browsing data
The IT systems and software procedures responsible for the functioning of this website acquire, during their normal activity, some personal data for which the transmission is implicit in the use of Internet communication protocols.
This is information that is not collected to be associated with identified subjects, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified.

This category of data includes IP addresses or domain names of the computers used by the users who connect to the website, the addresses in URI (Uniform Resource Identifier) notation of the required resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the code number indicating the response status given by the server (successful outcome, error, etc.) and other parameters related to the operating system (fingerprint) and to the user's IT environment.

These data are used for the sole purpose of obtaining anonymous statistical information on the use of the website, to allow browsing the website and to check its correct functioning. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the website, and for the same reason kept by the ISP (Internet Service Provider, Internet connectivity provider) and by the web host.


Sending e-mails through the contacts indicated in the appropriate section
The optional, explicit and voluntary sending of e-mails to the addresses indicated on this website involves the subsequent acquisition of the sender's address, necessary in order to respond to requests, and of any other personal data contained in the message itself. The e-mail address thus acquired is not used for other purposes and the simple sending of an e-mail for contact purposes does not entail the registration to mailing lists with the purpose of sending advertising material. For the processing in question it is not necessary to acquire your prior consent as responding to the requests sent to us represents a legitimate interest of the Data controller.

The processing of the data requested is therefore optional but necessary for the purpose of formalising your request: if you refuse to provide such data Hotel Fontanelle will not be able to take your request into consideration.
Your data will be stored no later than the termination of the request.

The section is used to allow registration to the mailing list for the purpose of sending promotional material on our services, offers and promotions.

In compliance with the requirements laid down by the General Regulation regarding the protection of personal data, the Data controller, Hotel Fontanelle S.N.C., provides the subject with the following information in relation to the processing of data:

The insertion of your data in the appropriate form is necessary to receive newsletters containing Special Rates, Offers and Promotions, Holiday Packages and Special Events.
For this purpose we need your explicit consent to be expressed at the bottom of this statement in the appropriate check box. The provision of data for this purpose is optional.
Your data will be used solely and exclusively to send these types of information and you may decide at any time to stop receiving further communications by simply clicking on the appropriate link attached to each newsletter.

Hotel Fontanelle will not transmit the data to third parties, nor will it disclose it in any way and guarantees that it will be handled exclusively by staff, specially selected and authorised.
The contact details to send communications and newsletters will be stored and used until you exercise the right to opt-out (revocation of consent), requesting that you no longer be contacted.

At any time you have the right, pursuant to arts. from 15 to 21 of the GDPR, to request the Data controller:

Finally, we remind you that you can, at any time, propose a claim before a supervisory authority (for example to the Authority for the protection of personal data) and that you have the right to obtain indications and/or specific clarifications concerning:

In implementation of the new EU regulation no. 679/2016 we inform you that:

The aforementioned Regulation provides for a series of obligations on the part of those who perform "treatments" (i.e. collection, recording, processing, storage, communication and other treatments listed in art. 4 of the Regulation) of personal data.
Your data will be processed on the basis of a contractual obligation or pre-contractual measures in order to manage the contractual relationship, comply with the obligations arising from the contract, manage passive billing, manage deliveries of supply materials and in order to ensure an effective operational management of the business relationship; we also process your data to fulfill legal obligations arising from tax and accounting legislation.

In order to allow the fulfillment of the contractual and legal obligations indicated above, your data will be processed using paper, electronic and telematic tools and supports, in compliance with the principles and requirements of the Regulation, as well as with company regulations and policies, by internal staff. specifically authorized and, in case it is necessary to make use of an external party for the treatment of the same, of specifically identified and appointed Data Processors; furthermore, they may be communicated to the following categories of recipients: to public entities and bodies (for example Chambers of Commerce, Financial Administration, other state or local public administrations or concessionaires of public services); to professional studies in order to fulfill fiscal and accounting obligations; to hardware and software maintenance and assistance companies in case of their intervention; to post offices, shippers and couriers. No personal data transfer is made to a third country or to an international non-EU organization.

For the aforementioned purposes and communications it is not necessary your prior consent, as the conferment and processing of data is necessary within the contract or the fulfillment of legal obligations. The provision of data is therefore necessary for the correct fulfillment of contractual and legal obligations since any refusal to provide them would make it impossible to fulfill the obligations.
On the basis of a legitimate interest of the data controller a video surveillance check of certain areas of the structure (accesses and corridors) is carried out, in order to protect the assets of the structure from theft and vandalism. The images will not be disclosed to third parties, except in cases where it is necessary to adhere to a specific request by the judicial authority or judicial police, and in any case the images will never be widespread; the images recorded are treated in accordance with the provisions of law and the provisions of the Guarantor on video surveillance.
Also in this case your prior consent is not necessary as the processing is based on the legitimate interest of the data controller to the protection and security of the company assets.

Data retention time
Your personal data will be stored only and exclusively for the period of performance of the activities subject of the contract and in any case no later than the expiration of the appropriate deadlines to ensure the possible defence of a right of the Company in litigation. In any case, they will not be kept for a period exceeding the achievement of the purpose.
The images of the video surveillance will be kept no later than the time required by current legislation.

Subjects' rights
In relation to the aforementioned processing and related data present in our archives, < the rights as of Chapter III, arts. From 15 to 22 of the EU Regulation 2016/679 can be exercised, and more specifically:
Right of access (art.15);

  • Right of rectification (art.16);
  • Right of cancellation (so-called right to be forgotten, art. 17);
  • Right to limit the processing (art. 18);
  • Right to data portability (art. 20);
  • Right of opposition (art. 21);

In addition, you have the right to propose a claim to a control authority, (for example to the Authority for the Protection of Personal Data). In order to exercise your rights you can contact the Customer by phone, mail or e-mail using the contacts indicated at the top of this statement.

Disclosure for the processing of personal data
In implementation of the new EU regulation no. 679/2016 we inform you that:

The aforementioned Regulation provides for a series of obligations on the part of those who perform "treatments" (i.e. collection, recording, processing, storage, communication and other treatments listed in art. 4 of the Regulation) of personal data referring to individuals.


Purpose of the processing and legal basis
The processing of your personal data that we hold or that will be requested or be communicated by you or by third parties is carried out in order to:

  • On the basis of a contract to which the subject is a part or to perform pre-contractual measures at the request of the user: manage your reservation of accommodation services and accessory services; perform check-in and check-out; manage active billing;
  • On the basis of legal obligations: fulfil the tax and accounting obligations; fulfil the obligations pursuant to art. 109 of the R.D. 18/06/1931 no.773 (Consolidated law on public security) on the communication to the Authority of Public Security of the generalities of the clients accommodated.


In these cases, the provision of data on your part is necessary for the execution of the contract and the fulfilment of legal obligations, therefore any refusal to confer them would result in us being unable to fulfil the obligations arising from the contract and legal obligations.

  • On the basis of consent expressed explicitly and unambiguously: send newsletters and advertising material regarding updates on fares and offers; store your data for a period not exceeding 24 months from the end of the stay in order to speed up the registration procedures in case of subsequent stays at our facility; carry out the function of receiving messages and phone calls on your behalf;


When the processing is based on consent, you have the right to withdraw the consent at any time without prejudice to the lawfulness of the processing based on the consent given prior to the revocation. The provision of consent is optional.

  • On the basis of a legitimate interest of the data controller: control through video surveillance of certain areas of the structure (accesses and corridors), in order to protect the assets of the structure from theft and vandalism. The images will not be disclosed to third parties, except in cases where it is necessary to adhere to a specific request by the judicial authority or judicial police, and in any case the images will never be widespread; the images recorded are treated in accordance with the provisions of law and the provisions of the Guarantor on video surveillance.

Method of processing
The processing will be carried out using paper, computerised and telematic tools and supports in compliance with the provisions of law, regulation and company policy aimed at ensuring the security, confidentiality, availability and integrity, as well as the accuracy, updating and the relevance of the data with respect to the purposes stated below. The processing will be carried out in compliance with the principles of correctness, lawfulness and transparency by internal staff specifically authorised and, in case it is necessary to use external parties to carry out certain treatments, these will be appointed Data Processors pursuant to art. 28 of the Regulation.


Data recipients
Apart from the video surveillance images and contact data used for the newsletter, your personal data, in order to fulfil the purposes described above, may be disclosed to: Financial administration, Public security authorities, Judicial police, Professional offices that perform accounting and fiscal consultancy activities for us, Companies providing assistance on management software in case of need, to other parties who can access your data in force of provisions of law or secondary or community legislation.


Data retention time
Your personal data will be stored no later than the time spent at our facility; in case you have given your consent for the further storage purpose indicated above, your data will be stored no later than 24 months after the end of your stay; in the event that you have given consent to the sending of the newsletter your contact details will be kept until the opt-out (revocation of consent), which you can express through the appropriate link present in any statement.


Subjects' rights
In relation to the aforementioned processing and related data present in our archives, the rights as of Chapter III, arts. From 15 to 22 of the EU Regulation 2016/679 can be exercised, and more specifically:
